Terms and Conditions – Kuchoriya TechSoft
Kuchoriya TechSoft provides professional software development services, web development solutions, and mobile app development on both time & material and fixed-price contracts. We are committed to transparency, high-quality service, and client satisfaction.
1. Payment Terms
- We provide detailed project cost estimates, exclusive of GST, VAT, or applicable taxes.
- Time-based pricing (hourly, weekly, or monthly) must be paid in advance as per the project proposal.
- Fixed-price contracts' payments follow agreed milestones and deliverables.
2. Resources and Working Hours
- Kuchoriya TechSoft assigns dedicated project managers, developers, and technical support staff based on project requirements.
- Our India development center operates Monday – Friday, 09:00 AM – 6:00 PM (IST, GMT +5:30).
- Public holidays are notified in advance, and timelines adjust accordingly.
3. Service Quality
We ensure top-notch IT solutions, software applications, and digital products are delivered on time and within budget, following best industry practices.
4. Operations
- Projects follow Agile methodology with frequent updates.
- Communication channels include email, Skype, SMS, and video calls as per client preference.
- We guarantee cost-effective and reliable IT services.
5. Client Responsibilities
- Provide clear project instructions for accurate timelines.
- Share instructions with the assigned project manager or developer.
- Give timely feedback to maintain project progress.
- Notify the team in advance of any feedback delays.
6. What We Avoid
- Working directly on live servers without client consent.
- Outsourcing development; all projects are covered under strict NDA agreements.
- Contacting your clients without prior approval.
7. Service Acceptance
- Clients should test projects on development servers before deployment.
- Post-completion, files/code are moved to production servers after full payment.
- Post-warranty, additional changes are chargeable.
- Ongoing backups of production data are the client’s responsibility unless defined in a Maintenance & Monitoring Agreement.
8. Modifications to Terms
Kuchoriya TechSoft may modify these Terms & Conditions. Clients are encouraged to check the page regularly. Collected information will be governed under the latest terms.
9. Invoices
- Invoices are issued hourly, weekly, monthly, or milestone-based as per agreement.
- Calculations follow standard company rates.
- Daily: 8 hours/day, Weekly: 5 days/week, Monthly: working days of the calendar month.
- Advance payment is required; otherwise, the project may be temporarily paused.
10. Termination of Services
Kuchoriya TechSoft may terminate services without liability if:
- Payment is not received within 5 days of invoice issuance.
- Client breaches terms and conditions.
- The project becomes undeliverable due to client constraints.
11. Warranty Period
- We provide a 30-day warranty post-deployment.
- Errors reported in writing during warranty are rectified free of cost.
- Errors caused post-deployment by third parties are not covered.
- No guarantee on commercial profitability of code or system.
12. Restrictions
- Clients should not directly hire our developers within 1 year of project completion.
- Clients should not engage with our clients independently.
13. Dispute Resolution
Any agreement between Kuchoriya TechSoft India Pvt. Ltd. and its clients shall be governed by the laws of India, with disputes subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan. For international clients working with Kuchoriya TechSoft LLC (USA), contracts shall follow the laws of the United States, and any disputes will fall under the exclusive jurisdiction of the courts in Denver, Colorado. This ensures clarity and legal compliance for all software development, IT solutions, and digital services provided by Kuchoriya TechSoft.
14. Return & Refund Policy
At Kuchoriya TechSoft, we specialize in providing custom software development, mobile app development, and web solutions. Since our services are digital and intangible, we do not offer returns or refunds once the project or service has been delivered successfully. However, client satisfaction is our top priority. If you face any issues with our IT services, web development, or app solutions, our team will work closely with you to resolve them and ensure the best possible outcome.
